**Terms and Conditions of Service**
**Imperial Cleaning Home Services LLC**
**Effective Date: [2024]**

**1. Subject of the Agreement**

1.1 Imperial Cleaning Home Services LLC commits to providing cleaning services according to the package chosen by the Client, as specified in the proposal or service description agreed upon.

1.2 The Client is responsible for providing accurate information regarding the type of service desired and the conditions of the location to be cleaned. If the Client opts for a standard service in situations that require a more complex service, such as a deep cleaning or move-out cleaning, the Company reserves the right to assess the location and suggest the most suitable service according to the conditions found.

1.3 If, upon arrival at the location, it is determined that the contracted service is not adequate for the actual condition of the environment (such as in cases of move-out, deep cleaning, or other specific needs), Imperial Cleaning Home Services LLC may recommend additional services, with an adjustment in cost proportional to the complexity of the required work. The Client will be informed about the necessity of the additional service and its corresponding cost, and their authorization will be required to proceed with the service.

1.4 If the Client chooses to maintain the initially contracted service without proper adjustment to the location’s needs, Imperial Cleaning Home Services LLC will not be held responsible for unsatisfactory results, unforeseen damage, or any failure to fully address the conditions of the environment and the Client’s request.

1.5 **Minimum Service Fee**
Due to operational costs involved in providing our services, we work with a minimum service fee. This fee is necessary to cover expenses related to the team’s travel, materials, and work time.

**2. Scheduling and Modification of Services**

2.1 Service scheduling will be confirmed by email, message, or another agreed-upon method between the parties.

2.2 Imperial Cleaning Home Services LLC requests that the Client considers a 30-minute to 1-hour window for the start of the scheduled services. This is due to the dynamic nature of our services, which involve the travel of our employees to the location, and the arrival time may vary due to traffic or other unforeseen factors.

2.3 If the Client requests to reschedule the service, Imperial Cleaning Home Services LLC reserves the right to schedule the new time for the next available slot in the Company’s calendar. The Company will do its best to accommodate the new time, but availability will depend on the schedule and logistics of our employees.

2.4 Any change or cancellation of the service must be made at least 24 hours in advance. Cancellations made outside of this period may be subject to a 20% fee of the contracted value.

2.5 The Company reserves the right to alter the service time or date due to unforeseen events such as extreme weather conditions, logistical issues, or employee health problems, with proper communication to the Client.

**3. Company’s Responsibility**

3.1 Imperial Cleaning Home Services LLC is committed to providing services with diligence and competence, adhering to hygiene and safety standards.

3.2 The Company has liability insurance that covers damages caused to items or property during the cleaning services, provided the damage is directly caused by the actions of our employees during the execution of the work. In case of damage to the Client’s items or property, the Company will take the necessary steps, as per the insurance policy conditions, to repair or compensate for the damage according to the terms and limitations of the insurance.

3.3 The Company is not responsible for damages to valuable or fragile items that are not properly informed or protected by the Client before the start of the cleaning services.

3.4 The Company is not responsible for damages to surfaces that are not suitable for the type of cleaning agreed upon (e.g., surfaces sensitive to certain cleaning products).

3.5 Imperial Cleaning Home Services LLC clarifies that its cleaning teams are not responsible for organizing or tidying up the spaces before starting the cleaning services. If the Client wishes for the property to be organized, this service will be charged separately, with additional costs, and must be agreed upon in advance.
Furthermore, if the required organization is extensive and impacts the time reserved for cleaning, there may be delays in meeting the scheduled time, affecting the services for the next client. To ensure service quality and adherence to the schedule, we recommend that the spaces be minimally organized before the cleaning team’s arrival.

3.6 **Trash Removal and Non-Inclusive Items**
The teams of Imperial Cleaning Home Services LLC are solely responsible for removing regular household trash during the cleaning service. Removal of furniture, appliances, heavy equipment, or large items is not included in the services. If the Client wishes to have any of these items removed, an additional fee will apply, to be agreed upon in advance, based on the availability of the team to carry out this service.
We emphasize that the cleaning team is not responsible for moving or transporting furniture, appliances, or heavy objects of any kind. All removal services must be requested in advance and will be subject to additional costs, depending on the complexity and time required for execution.

3.7 **Damaged Items and Cleaning of Broken Items**
The teams of Imperial Cleaning Home Services LLC are not responsible for cleaning damaged or broken items within the property, including furniture, appliances, objects, or any other items that are physically compromised. If the cleaning team identifies any damaged items during the service, the damage will be documented through photographs and reported to the Client immediately after the discovery.
This procedure is in place to protect both the company and the Client, ensuring that any pre-existing issues or damages are properly documented and communicated. The photos will serve as a record for the company, which may be used in case of complaints or disputes regarding the condition of items at the time of the cleaning.

3.8 **Paint Stain Cleaning**
Imperial Cleaning Home Services LLC is not responsible for removing paint stains from walls, windows, floors, or other surfaces during post-construction, renovation, or move-out cleaning services. Paint removal is a specialized task that may take several hours and impact the time and cost of the service. Protecting the property areas to avoid paint stains is the responsibility of the painting team. If the Client wishes to have paint stains removed, a separate and specific estimate will be required and agreed upon in advance. The cleaning team will perform the standard cleaning, but paint stain removal is not included in the contracted package.

3.9 **Complete Services**
Please note that to ensure the quality and efficiency of our work, we do not perform incomplete services. For example, it is not possible to book cleaning for only two bathrooms or a single bedroom without the entire property being attended to.
Our commitment is to provide comprehensive, high-quality cleaning for all areas of the house or establishment, according to the agreed scope.
If you have specific needs, such as focusing on priority areas, please contact us to discuss alternatives that will meet your expectations, while still respecting the integrity of the service provided.

3.10 **Duration of Our Cleaning Services**
On average, our cleaning services usually take between 1 to 5 hours to complete, depending on the complexity and size of the area to be cleaned. This time is estimated to ensure a high-quality, thorough cleaning without rushing.
If more time is needed to complete the service, our team will always inform the Client in advance, so they are aware of any adjustments to the schedule.
For special services, such as deep cleanings or specific tasks (like carpet cleaning, window cleaning, or hard-to-reach areas), the duration may be even longer and could take several days to complete, depending on the type of work involved.
Our goal is always to ensure the best service quality, and we are committed to maintaining transparency regarding the time required to complete each task. If you have any questions about the estimated time for your service, please don’t hesitate to ask.

3.11 **Regular Cleaning Service Booking**
For regular cleaning service bookings, it is important to note that the first cleaning must be a deep cleaning. This is necessary to bring the property to the cleaning standards we follow and ensure all areas are in ideal condition for ongoing services.
Regular cleanings after the deep cleaning tend to be faster, averaging 1 to 5 hours for completion, depending on the complexity and size of the space to be cleaned.
If the service requires more time, our team will inform the Client in advance. For special services, such as carpet cleaning, window cleaning, or other specific areas, the execution time may be even longer, potentially extending over several days, depending on the work involved.
Our goal is to ensure the highest quality in our services, and performing a deep cleaning on the first booking is essential to achieve our high standards of hygiene and organization.

3.12 **Gift Cleaning**
When booking a Gift Cleaning service, the same terms and conditions as regular cleanings for other clients apply. This includes, but is not limited to, the scope of service, cancellation and rescheduling policies, prices, and payment methods.
The client who books the Gift Cleaning will be responsible for the payment of the service, and the recipient of the gift may schedule the service at their convenience, following the established conditions.
The scheduling process, service check, and any other conditions related to the booked service will follow the same standards as a regular cleaning, with proper communication between the company and the gift recipient.

**4. Customer’s Responsibilities**

4.1 The Customer must ensure that the location is accessible and safe for the service providers, including providing adequate conditions for cleaning to be performed.

4.1.1 In cases where the location presents a biological contamination risk for the Company’s employees (such as, but not limited to, the presence of hazardous substances, mold, pest infestation, or biological materials), Imperial Cleaning Home Services LLC reserves the right to cancel or delay the service execution without any liability until the safety conditions are restored. The Company may require the Customer to provide assurances that the location has been properly disinfected or that the risk situation has been addressed before services can resume.

4.2 The Customer is responsible for clearly informing the Company of any items or areas that require special care or should not be cleaned.

4.3 The Company will not be responsible for any items or areas that, although the responsibility of the Customer, were not properly indicated before the service began. The Customer must ensure that all fragile, valuable, or sensitive items are removed or adequately protected before the services are performed. This includes, but is not limited to, furniture, decorative items, electronics, sentimental items, and any other items that, in case of damage, could result in additional costs or issues.

4.4 The Customer must ensure that the environment is free of obstacles or conditions that could hinder or prevent the efficient execution of the service. This includes, but is not limited to, trash, excessive clutter, heavy furniture, or any other items that could obstruct the work of the Company’s professionals. If the team encounters obstacles that were not previously informed, the Company may suggest an adjustment to the scope of work or even the need to reschedule, and an additional fee may apply.

4.5 If the Customer provides false or incomplete information regarding the location or type of service required, Imperial Cleaning Home Services LLC reserves the right to stop the service execution. In such cases, the Customer may be charged for the part of the service already performed and will not be entitled to a refund of any amounts paid.

4.6 The Customer is responsible for ensuring that the area is safe for the services to be carried out. This includes, but is not limited to, ensuring that there are no unsafe conditions, such as wet floors, slippery surfaces, or other risks that could harm the safety of the team or damage property on the premises.

4.7 For move-in, move-out, or post-construction services, the property must be completely empty at the time of cleaning. There should be no furniture, personal belongings, construction materials, or any other items on the premises. Additionally, no individuals should be present in the residence during the service to ensure the safety and efficiency of the cleaning team.

4.8 If the property is not completely vacated or if materials have not been removed, any item present will be considered trash and may be discarded unless the Customer gives specific and prior notice of items that should not be removed or discarded. Imperial Cleaning Home Services LLC will not be responsible for any items considered trash that were not identified in advance by the Customer.

**5. 100% Satisfaction Guarantee**

5.1 Imperial Cleaning Home Services LLC is committed to ensuring 100% satisfaction with the services provided. If the Customer identifies any item or area of the cleaning that was not performed as expected or was incomplete, the Company commits to returning to the property and redoing the service at no additional cost to correct what was identified as missing or unsatisfactory.

5.2 The request for correction must be made by the Customer within 24 hours after the service is completed, via email or phone, clearly stating what needs to be redone.

5.3 The correction will be scheduled by the Company within 24 hours after the request, with the Customer being informed of the time and date of the visit.

5.4 This guarantee does not apply to situations where the failure results from a lack of clear information, inaccessible areas for the team, or in cases of damage to fragile or unprotected items as specified in Clause 4.2.

5.5 The Company reserves the right to assess the service to confirm the nature of the request before returning to the location.

**6. Limitation of Liability**

6.1 Imperial Cleaning Home Services LLC will not be responsible for indirect, special, incidental, or consequential damages, including, but not limited to, loss of profits, business interruption, or property damage not directly caused by the actions of its employees during the execution of the services.

**7. Confidentiality**

7.1 Customer Information Confidentiality: Imperial Cleaning Home Services LLC is committed to keeping all information provided by the Customer confidential, including, but not limited to, personal data, contact information, details about the cleaning location, preferences, and any other sensitive data shared during the provision of services.

7.2 Data Protection: The Company will take reasonable measures to protect the Customer’s information from unauthorized access, loss, theft, or misuse. However, Imperial Cleaning Home Services LLC will not be responsible for security breaches beyond its direct control, such as external system intrusions or data breaches caused by external factors.

7.3 Limited Disclosure: The Company will not disclose or share any Customer information with third parties, except when necessary to fulfill service obligations, or when required by law, court order, or other competent authority.

7.4 Employee Confidentiality: All employees, contractors, or service providers of Imperial Cleaning Home Services LLC sign confidentiality agreements before starting their activities, ensuring that Customer information is not disclosed or misused during or after the provision of services.

7.5 Exceptions to Confidentiality: The confidentiality obligation will not apply to information that:
a) Was in the public domain at the time of disclosure;
b) Was publicly provided with the Customer’s consent;
c) Was legally obtained from external sources without violating any confidentiality obligations;
d) Is disclosed to comply with a court order or legal requirement.

7.6 Data Retention: Imperial Cleaning Home Services LLC may retain the data provided by the Customer for the duration necessary to fulfill the agreed services or as required by law. However, data will be securely eliminated or destroyed when no longer needed for the purposes for which they were collected, unless otherwise required by law.

**8. Personal Data Protection**

8.1 Imperial Cleaning Home Services LLC respects the privacy and protection of its customers’ personal data. All personal information provided by the Customer will be processed in accordance with applicable data protection laws and regulations, including, but not limited to, the Washington State Consumer Privacy Act and other relevant federal or state regulations.

8.2 The Customer agrees to the collection, processing, and use of their personal information for the specific purposes of providing the contracted services. This information may include, but is not limited to, name, address, phone number, and payment information.

8.3 The Customer has the right to access, correct, or delete their personal information, as well as to withdraw consent for the use of their data at any time. To do so, the Customer must contact Imperial Cleaning Home Services LLC through the provided communication channels.

8.4 The Company commits to adopting appropriate security measures to protect the Customer’s personal information from unauthorized access, loss, or misuse. However, the Company will not be responsible for security failures beyond its control, such as external cyberattacks.

**9. Dispute Resolution**

9.1 Informal Negotiation: In the event of a dispute or disagreement related to this agreement, both parties agree to attempt to resolve the dispute amicably and in good faith, starting with informal negotiation between the Customer and Imperial Cleaning Home Services LLC.

9.2 Mediation: If the dispute cannot be resolved amicably, the parties agree to submit the dispute to mediation. The mediation will be conducted by an impartial mediator chosen by mutual agreement between the parties. Mediation must occur within 30 days of the mediation request.

9.3 Binding Arbitration: If mediation is unsuccessful, the parties agree that any remaining dispute will be resolved by binding arbitration, according to the arbitration rules of the state of Washington. Arbitration will be conducted by a single arbitrator, and the venue will be in Seattle, Washington. The arbitrator’s decision will be final and binding, and may be entered as a judgment in any competent court.

9.4 Waiver of Class Action: The Customer and Imperial Cleaning Home Services LLC agree that any dispute or claim will be resolved individually, and there will be no class, representative, or other collective actions in any arbitration or legal proceedings related to this agreement.

**10. General Provisions**

10.1 **Force Majeure:** Neither party shall be liable for any failure to perform their contractual obligations if such failure is caused by events beyond the reasonable control of the affected party, including but not limited to natural disasters, epidemics, pandemics, changes in applicable regulations or laws, strikes, labor disputes, power or internet supply failures, and governmental or military acts.

10.2 **Amendments to the Contract:** Imperial Cleaning Home Services LLC reserves the right to modify, alter, or update these Terms and Conditions at any time. Any changes will be communicated to the Customer, and continued use of the services after the notice of change constitutes acceptance of the new terms.

10.3 **Severability:** If any provision of this contract is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect as if the invalid, illegal, or unenforceable provision had not been included.

10.4 **Assignment and Transfer:** The Customer may not assign or transfer their rights or obligations under this contract without the prior written consent of Imperial Cleaning Home Services LLC. The Company may assign its rights and obligations to third parties without the Customer’s prior consent, provided the Company ensures the services will be delivered according to the same quality standards.

10.5 **Entire Agreement:** These Terms and Conditions represent the entire agreement between the parties and supersede all prior negotiations or agreements, whether oral or written, relating to the subject matter of this contract.

10.6 **Governing Law:** This contract will be governed and construed in accordance with the laws of the state of Washington, without regard to conflicts of law principles. Any dispute will be resolved in courts located in Seattle, Washington.

**11. Limitation of the Teams’ Authorities**

11.1 **Restricted Authority:** The cleaning teams of Imperial Cleaning Home Services LLC have no authority to negotiate prices, alter the scope of services, or make contractual decisions on behalf of the company. Any changes to the contracted service, price adjustments, or other modifications must be discussed directly with the company’s administration through official communication channels.

11.2 **Prohibition of Negotiation and Contract Adjustments:** Cleaning team members are not authorized to conduct any negotiations regarding prices, service packages, or contractual conditions. If the Customer wishes to request an additional service or modification, it must be done directly with Imperial Cleaning Home Services LLC so that the changes are formally agreed upon and documented.

11.3 **Financial Transactions:** Cleaning teams are not authorized to provide payment methods, such as credit card numbers, bank details, or personal payment information, nor are they authorized to receive any money or carry out financial transactions on behalf of the company. All payments must be made exclusively through the official payment channels of Imperial Cleaning Home Services LLC, and any payment received directly by the team will be considered invalid.

11.4 **Limitation of Personal Contact:** Cleaning teams are not authorized to provide personal contact information, such as phone numbers, emails, or business cards. Additionally, they are not permitted to request or collect any type of contact information from the client for purposes unrelated to the execution of services, such as future personal or business contacts.

11.5 **Administration Responsibility:** Any decision or modification to the services provided will be made exclusively by the administration of Imperial Cleaning Home Services LLC. Team members must follow the guidelines and instructions provided by the company, maintaining a professional attitude and strictly adhering to the conditions and terms agreed upon with the Customer.

**12. Communication and Team Instructions**

12.1 **Service Designated by the Company:** The cleaning teams are performing the contracted service **at the direct request of Imperial Cleaning Home Services LLC and with the objective of fulfilling a specific service previously assigned by the company.** The cleaning teams are not authorized to follow instructions or directions provided directly by clients on-site.

12.2 **Exclusive Communication Channel:** Any changes, adjustments, or additional requests related to the service must be communicated directly to Imperial Cleaning Home Services LLC and should not be made directly with the cleaning team. The company will be responsible for relaying the necessary instructions, adjustments, or updates to the cleaning team, ensuring that the service is performed in line with the customer’s expectations.

12.3 **Prohibition of On-Site Mediation:** No on-site mediation between the customer and the cleaning team will be allowed. All instructions, changes, or requests must be formally addressed to the company’s administration, which will then pass these instructions to the team in an organized and controlled manner.

12.4 **Responsibility for Service Execution:** The responsibility for service execution lies strictly with the company, which will ensure that the teams follow the established guidelines and standards. Imperial Cleaning Home Services LLC is the only entity authorized to alter the scope of service, issue instructions to the teams, and resolve any customer inquiries or requests.

**13. Payment Conditions**

13.1 **Service Fee:** The total fee for the cleaning service will be as specified in the initial estimate, as agreed between the Customer and Imperial Cleaning Home Services LLC. If the Customer requests additional services or extras, or if there are changes to the initially contracted service scope, the fee will be adjusted according to the nature and complexity of the services provided, with prior communication and approval from the Customer.

13.2 **Payment Methods:** Payment must be made only through the official payment channels provided by Imperial Cleaning Home Services LLC. The Company accepts the following payment methods:

– Cash
– Check
– Bank transfer
– Online payment (Venmo, Zelle, CashApp)
– Other payment methods agreed upon by the Company and the Customer

13.3 **Payment Deadline:** Payment should be made immediately after the completion of the service, with a maximum deadline of 24 (twenty-four) hours after the work is finished. If deferred payment is necessary, the Customer will be informed of the maximum deadline for payment. Failure to meet this deadline may result in additional fees or collection actions, as outlined in this clause.

13.4 **Non-Payment:** If the Customer fails to make payment within the established deadline, Imperial Cleaning Home Services LLC reserves the right to suspend the provided services until payment is regularized. The Customer agrees that, in case of non-payment, a monthly interest fee of 2% on the total amount due may be charged, along with administrative and legal costs necessary for credit recovery.

13.5 **Refunds:** No refunds will be issued after the service has been provided, except in exceptional cases outlined by the 100% Satisfaction Guarantee Policy (Clause 5). If the Customer requests a refund or adjustment to the amount due to dissatisfaction with the service, the conditions will be reviewed according to the established policy and the circumstances of the case.

13.6 **Cancellation and Payment:** If the Customer decides to cancel the service after confirming the booking but before the service execution, a cancellation fee will apply as per the company’s policy, which will be communicated to the Customer in advance.

13.7 **Payment Confirmation:** After payment, the Customer will receive a payment confirmation via email or another agreed-upon method. Imperial Cleaning Home Services LLC is not responsible for unregistered or misdirected payments. The Customer must ensure that all payments are made correctly, and any errors must be reported immediately to the company’s administration for resolution.

13.8 **Default and Legal Action:** If the Customer fails to make payment after the stipulated deadline, Imperial Cleaning Home Services LLC reserves the right to take appropriate legal action to recover the amount owed, including contracting collection services or filing a lawsuit. All legal costs, collection fees, and interest will be the Customer’s responsibility.

**14. Authorization for Image Capture**

14.1 The Customer agrees that, during the execution of cleaning services, Imperial Cleaning Home Services LLC may capture photographic images of the areas of the property where services are being performed. Photographs will be taken before, during, and after the service execution, solely for the purpose of documenting the quality and integrity of the service performed.

14.2 The captured images will be used exclusively for internal verification of service execution and to ensure the quality of the work performed. Photographs will not be shared with third parties unless required by law or at the explicit request of the Customer.

14.3 The Customer acknowledges and authorizes the use of these images by Imperial Cleaning Home Services LLC for quality control, continuous improvement, and resolution of potential disputes regarding the service execution.

14.4 The Customer may, at any time, request the deletion of the images by sending a formal request to Imperial Cleaning Home Services LLC. However, to ensure transparency and integrity of the service, the images may be retained for up to 6 months after the service is completed, in accordance with the company’s internal policy.

**15. Discounts and Promotions**

15.1 **Imperial Cleaning Home Services LLC** offers various promotions and discounts to benefit our customers. The conditions for each discount are as follows:

15.2 **Referral Discount:** If you refer our services to another person and they hire our services, both the referred customer and the referring customer will receive a 30% discount on the next cleaning. This benefit will be applied after the confirmation of the referred service booking. The referral discount is not cumulative with other promotions.

15.3 **First Cleaning Discount:** New customers can enjoy a 20% discount on the first cleaning performed, without the need for a referral. The discount will be provided at the time of scheduling. This discount is not cumulative with other discounts.

15.4 **Senior and Veteran Discount:** We offer exclusive 25% discounts for seniors and veterans as a token of appreciation for their support of our community. To qualify for this benefit, the customer must inform their status at the time of scheduling. This discount is also not cumulative with other promotions.

15.4.1 **Verification for Senior or Veteran Discount Application:**
To apply the 25% senior or veteran discount, we ask that the customer provide proof of their status, such as one of the following options:
– **Identity Document with Age:** For seniors, we request an identity document (such as a driver’s license, passport, or another official document) showing the customer’s age, confirming that they are 60 years or older.
– **Veteran Status Proof:** For veterans, we ask for a valid veteran identification, such as a veteran card, honor letter, or another official document proving veteran status.

This documentation can be provided simply by sending a photo of the document via email or message to ensure customer privacy and security.
After verifying the documentation, the discount will be applied automatically to the total cost of the cleaning.
**Note:** The information provided will be treated with complete confidentiality and used solely for the purpose of applying the discount. Imperial Cleaning Home Services LLC is committed to respecting the privacy of customers in all aspects.

15.5 **Seasonal Discounts:** During holidays and seasonal changes (spring, summer, fall, and winter), the company offers seasonal discounts. These special offers will be posted on our social media and website, and customers can take advantage of these promotions to get the best prices. Seasonal discounts are also not cumulative with other promotions.

15.6 All discounts are applicable according to the specific conditions of each promotion and cannot be combined unless indicated otherwise. For more details on current promotions, please check our social media or contact us directly.
